Resolving family law problems can be frustrating. At Sanders Legal we know it can be difficult to reach an agreement involving a contentious matter. We prepare for trial from day one but when appropriate, encourage our clients to use alternative disputes resolution methods such as mediation. These methods are often more cost effective than going to court and allow participants to retain some control while crafting a creative solution. We work with clients in a variety of divorce matters, including:

  • Separation agreements: In order to qualify for a voluntary separation agreement, you must have been separated for a year. To qualify for an involuntary separation, you must have been separated for two years.
  • Custody and visitation: Child custody and visitation arrangements are always centered around the best interest of the child. Most courts assume that the child will be raised better if they spend time with both parents and if both parents work together to make important decisions regarding the child's life. We help our clients resolve issues involving stability, the school district, medical treatment issues, insurance for kids and time with half-siblings.
  • Property division: Dividing assets — especially the house — can be a difficult point for many couples. Regardless of how it the property is titled, all property acquired during the marriage is considered marital property. We encourage our clients to use mediation to reach agreements. The court divides property equitably, but that does not necessarily mean equally.
  • Alimony: Receiving spousal support or alimony is not guaranteed at the end of a divorce. The court assumes that every adult can take care of him or herself. To receive alimony, it is necessary to show disparity between the spouses or prove that one of the adults is disabled.
